Welcome to Plastiks, owned and operated by Nozama Tech LTD, Blair House, Upper O'Connell Street, Ennis, Co. Clare, Dublin X789X45, Ireland ("Plastiks," "we," "us", or "our"). These Terms of Service ("Terms") govern your access to and your use of the Plastiks website(s), our APIs, mobile app (the "App"), and any other software, tools, features, or functionalities provided on or in connection with our services; including without limitation using our services to view, explore, and create NFTs and use our tools, at your own discretion, to connect directly with others to purchase, sell, or transfer NFTs on public blockchains (collectively, the "Service").

"NFT" in these Terms means a non-fungible token or similar digital item implemented on a blockchain (such as the Ethereum blockchain), which uses smart contracts to link to or otherwise be associated with certain content or data.

For purposes of these Terms, "user", "you", and "your" means you as the user of the Service. If you use the Service on behalf of a company or other entity then "you" includes you and that entity, and you represent and warrant that (a) you are an authorised representative of the entity with the authority to bind the entity to these Terms, and (b) you agree to these Terms on the entity's behalf.

Plastiks is not a wallet provider, exchange, broker, financial institution, or creditor. Plastiks provides a peer-to-peer web3 service that helps users discover and directly interact with each other and NFTs available on public blockchains.

We do not have custody or control over the NFTs or blockchains you are interacting with and we do not execute or effectuate purchases, transfers, or sales of NFTs. To use our Service, you must use a third-party wallet which allows you to engage in transactions on blockchains.

Excepting the data related to the invoice used by the waste management company or the plastic recovery project, Plastiks is not party to any agreement between any users. You bear full responsibility for verifying the identity, legitimacy, and authenticity of NFTs that you purchase from third-party sellers using the Service and we make no claims about the identity, legitimacy, functionality, or authenticity of users or NFTs.

Privacy

By using the Plastiks website and its services, you consent to the following privacy terms. We respect your right to privacy and control over your personal information. Plastiks may collect and use your personal data as part of the Services, as explained in the following information.

A. Responsible body

The responsible body for the collection, processing, and use of your personal information through the Services is Plastiks.io.

B. Collection, processing and use of personal data

When you use the Services, we may collect device and browser metadata such as IP addresses, operating system type and version, date and time of access, the URLs of the pages you visited and for how long, any referrer URL, interactions with the user interface, the name of your access provider, and analytics information used by services such as Google Firebase, Google Analytics and others.

To use the Services, you may be asked to register by providing registration information. If you register, some or all of the following information may be collected: first and last name; account username; company; email; telephone; cryptocurrency wallet address.

The registration data is processed to verify your identity and location, and to help us connect you to your historical data and account. By registering and using the Services, you consent to receive follow-up questions and other communication, either from us or from relevant third parties.

We use the personal information we collect to provide smooth and secure access to our website, services and offerings; to ensure a good user experience; to evaluate system security and stability; and for administrative purposes — including to facilitate interactions in the Services, provide customer support, respond to requests, create and manage your account, fulfil orders, improve and develop our services, prevent and respond to unauthorised activity, and comply with the law. The legal basis for this processing is your consent and the fulfilment of our obligations and provision of Services.

C. Creating an account

When you create an account, we may use your name or email address as your login name. The creation of an account is required because the Services may not work without historical data. The legal basis of the processing is your consent.

D. Use of the Services

In accessing and using the Services, files and other content might be uploaded or created, and usage-related data can be created, collected and processed. If you upload information or content to the Services, you should expect that information or content to be shared with others where its nature supports sharing.

Information you upload is stored on appropriate server infrastructure for processing. Data is presently stored for up to 10 years, though this may change over time. In order to protect our community and comply with our legal obligations, we reserve the right to take action, with or without advance notice, if we believe you have violated these Terms. You agree that you will not violate any law, contract, intellectual property or other third-party right, and that you are solely responsible for your conduct and content while accessing or using the Service.

E. Cookies

We use cookies on the website. Cookies are small files that your browser creates and stores on your device when you access the Services; they do not harm your device and do not contain malicious software. The use of cookies serves to increase the usability of the Services and to statistically record and optimise their use.

Most browsers accept cookies automatically, but you can configure your browser to refuse cookies or to warn you before one is stored. Disabling cookies may mean you cannot use all features of the Services. We may also use Local Storage and Pixel Tags to remember preferences and measure usage. Some browsers offer a "Do Not Track" feature; DNT signals are not yet uniform. The App does not use cookies; it stores session data in an encrypted keychain.

F. Analytics and additional services

We may use web analytics and other services for the continuous optimisation of the Services, providing a statistically accurate record of their use. The legal basis for this processing is our legitimate interest in the needs-based design and continuous optimisation of the Services. You can prevent the collection of analytics data by opting out; an opt-out cookie will then be set.

G. Social media plug-ins

We may use social plug-ins from services such as Facebook, Instagram, X (Twitter) and LinkedIn to raise awareness of the Services. We are not responsible for activity or content on third-party sites. A link to a third-party website does not mean we have reviewed or endorsed its privacy practices.

H. Server location

The servers on which user data is collected, stored and used are located in the United States (Oregon, Georgia, Virginia, North Carolina and South Carolina) and in Europe (Eemshaven and Groningen in the Netherlands, and Mons, Belgium).

I. Registration

For registrations in the European Union we use the double opt-in procedure. After registration we will send a notification email asking you to confirm that you wish to receive further information from Plastiks. You can unsubscribe at any time using the link in any of our emails, after which we will delete your email address from our mailing list. We may still use your email address to process a password reset.

J. Your rights under the GDPR

In connection with the data processing described here, you have the right to: request information about your personal data processed by us; demand the correction of inaccurate or incomplete data; demand the deletion or restriction of processing of your data (subject to legal exceptions); receive your data in a structured, machine-readable format or request its transmission to another controller; revoke consent at any time; and lodge a complaint with the supervisory authority of your place of residence or work.

Note that the Services employ smart contracts that collect information stored on a blockchain we do not control. If you use the Services, you consent to your information being cryptographically transmitted and stored on that blockchain, and any deletion or modification is governed by the terms of the relevant smart contract.

K. Withdrawal and objection

You have the right to object to the processing of your personal data, and to revoke any consent once given, at any time. Revoking consent does not affect the lawfulness of processing carried out before the revocation. To exercise your right of withdrawal or objection, please email support@plastiks.io.

L. Storage time

We store personal data only as long as necessary to fulfil the contractual or legal obligations for which it was collected, after which we delete it — unless we are required to retain it for evidence or statutory storage requirements. Statutory retention periods range from two to ten years.

M. Data security

Access to your account is only possible after entering your personal password; keep your access information confidential. We use SSL/TLS encryption at the highest level supported by your browser (generally 256-bit), and take appropriate technical and organisational measures to protect your data. No system or electronic transmission is completely secure, so any transmission of your personal information is at your own risk. We may suspend your use of the Services if we suspect or detect a breach of security.

N. Children's information

The Services are intended solely for adults. We do not knowingly collect information from children under the age of 13. If you believe a child has provided us with personal information, please contact support@plastiks.io and we will promptly delete it along with the child's account.

O. Changes

This policy is effective as of August 2022. As our site evolves, or as a result of changes in regulatory requirements, it may be necessary to change this policy. The current version can be retrieved and printed at any time from the URL you are viewing.
